- Definitions
- 1.1 The Company means 3 Counties Motorcycle Training.
- 1.2 The Customer means any person or organisation that engages the services of The Company
- 1.3 The Course means any services provided by the Company to the Customer
- 1.4 The Agreement means the Agreement between the Company and the Customer for the provision of services which incorporates these Terms and Conditions.
- 1.5 The Fee means any payment made by the Customer to the Company
- 1.6 Working Days means Monday to Friday inclusive and excludes Saturdays, Sundays and bank holidays.
- Terms of Payment
- 2.1 A deposit or payment in full is payable at time of booking.
- 2.1.1 For Courses less than £300 in value: Payment in full is required at time of booking.
- 2.1.2 For Courses greater than £300 in value a deposit of 50% of the course fee or £300 (whichever is the greater), is payable at time of booking.
- 2.2 Deposit is non-refundable.
- 2.3 The balance of all Course fees is payable no less than 14 clear working days prior to the start of the Course or part thereof date.
- 2.4 The Company accepts payment with all major credit and debit cards, online through our booking system at 3cmt.co.uk. The company does not accept cheques or cash.
- 2.5 Courses must be booked in the name of the Customer undergoing training and are not transferable.
- 2.1 A deposit or payment in full is payable at time of booking.
- Customer Obligations
- 3.1 In accordance with DVSA policy the Customer must be able to understand and speak English.
- 3.2 If the Customer is under 18 years of age a responsible adult must sign their disclaimer at the start of their Course, agreeing to these terms and conditions.
- 3.3 The Customer will provide accurate information to the Company
- 3.3.1 Information must be provided within any timescale requested by the Company.
- 3.3.2 Inaccurate information provided by the Customer about any prior riding experience may affect the Customer’s ability to complete training within the booked Course period and may require further paid training.
- 3.3.3 The Customer must provide the Company with their full Driving Licence number and a valid DVLA check code within 3 days from booking letter date.
- 3.3.4 The Customer will ensure that they have the necessary documents to ride a motorcycle/moped on the public highway in the United Kingdom.
- 3.3.4.1 For Customers using a Company hired motorcycle this will require
- 3.3.4.1.1 A valid driving licence containing provisional entitlement for the type of machine to be ridden during training. (Category AM for a moped or category A1, A2 or A for a motorcycle).
- 3.3.4.1.2 The licence photocard must be shown to the Company at the start of any Course and must be brought to all Course dates.
- 3.3.4.1.3 If the Customer has an older paper licence then a valid passport must also be shown.
- 3.3.4.2 If the Customer uses a motorcycle/moped (vehicle) which is not provided by the Company the Customer will ensure that it is in good and sound mechanical order. Vehicle mechanical state and documentation will be checked at the start of any training and failure to comply with the requirements will result in training being cancelled and loss of all fees paid.
- 3.3.4.2.1 That the Customer has valid insurance cover for that vehicle
- 3.3.4.2.2 The vehicle has valid vehicle tax
- 3.3.4.2.3 The vehicle has a valid MOT (where applicable),
- 3.3.4.2.4 The vehicle is displaying full size L plates front and rear.
- 3.3.4.2.5 The vehicle speedometer displays in MPH. No stickers or overlays to indicate MPH are permitted.
- 3.3.4.1 For Customers using a Company hired motorcycle this will require
- 3.4 The Customer will provide and wear suitable protective clothing consisting of
- 3.4.1 A motorcycle jacket, motorcycle trousers, motorcycle gloves and strong boots
- 3.4 .2 Or at the minimum a strong jacket, long hard wearing trousers (minimum strong denim), stout footwear covering the ankle (avoiding steel toecaps) and motorcycle gloves. No exposed flesh.
- 3.4.3 The Customer is required to bring their own undamaged ECE2205 or ECE2206 approved motorcycle helmet for training.
- 3.4.4 The Company shall provide Hi-Viz during training
- 3.5 The Customer must be able to read (with glasses or contact lenses, if necessary) a car number plate made after 1 September 2001 from 20 metres.
- 3.6 The Customer will inform the Company at time of booking or at the time such knowledge becomes known to the Customer of any medical condition or medication which may affect their ability to start, continue or complete the Course. Medical evidence may be requested.
- 3.7 The Customer will not be under the impairment of any drink, drug, or medication.
- 3.8 The Customer will read and understand the Highway Code prior to attending the Course.
- 3.9 The Customer must arrive sufficiently (15mins) before any Course start time to allow the Course to start on time.
- 3.10 The Customer must advise the company during training if for any reason they feel unfit to continue.
- 3.11 The Customer must ensure they are physically fit, strong and tall enough to be able to manoeuvre and sit safely on any training machine.
- 3.12 Any outstanding training dates must be arranged with the Company and completed within 3 months of commencement of the course or part of the course package, whichever is the earliest date. Any unused training after this date will expire with the loss of any fees.
- 3.13 Failure by the Customer to comply with their obligations may result in cancellation of your training and loss of your Fees.
- Companies Obligations
- 4.1 The student/instructor ratio for each Course will be at the discretion of the Company, and will conform to DVSA requirements.
- 4.2 The Company will determine the aptitude of the Customer for each Course.
- 4.3 The Company will determine when the Customer progresses to a category A2 or A motorcycle.
- 4.4 The Company shall hold insurance in respect of at least the minimum legal requirement.
- 4.5 If the Company considers it necessary to cancel the Training Course due to unsafe weather conditions then
- 4.5.1 No refund will be offered for cancellation due to weather.
- 4.5.2 Alternative mutually convenient training dates will be arranged.
- 4.5.3 The Customer will be responsible for any further test fees.
- 4.6 The Company reserves the absolute discretion to cancel your training or test if you are unfit due to any reason, including but not confined to misuse of alcohol or drugs. No refund will be payable in such circumstances.
- Cancellation
- 5.1 No refund will be payable by the Company in respect of the Customer’s failure to comply with their obligations.
- 5.2 No refund will be payable by the Company unless the Course is cancelled no less than 12 clear working days in advance, not including the day of cancellation or the 1st day of the Course
- 5.3 Upon cancellation in accordance with paragraph 5.2 above
- 5.3.1 There will be a refund of any fees paid greater than the deposit fee.
- 5.3.2 If a Course is less than the deposit fee in 2.1 then no refund will be given.
- 5.4 In the event of a cancellation within 12 clear working days prior to the Course commencement date no refund shall be given and any outstanding fees owed by the Customer for the full Course shall be payable.
- 5.5 No refund in whole or part shall be payable once any contracted element of a Course has commenced.
- 5.6 If the Customer requests to change Course dates after a confirmed booking has been made in accordance with section 2, then any new training dates and DVSA test bookings will be treated as new bookings at normal rate. At the discretion of the Company any originally booked dates and / or DVSA test fees may in whole or part be credited to the customer’s 3CMT training account.
- 5.7 No refund shall be given and the Company shall not be liable for any training lost due to the Customer’s inability to attend the Course or any part thereof for any reason.
- 5.8 The Company reserves the right to cancel any part or whole of the Customer’s training due to safety concerns concerning the Customers ability or suitability to ride. All course fees will be forfeit.
- 5.9 Training is offered as a Leisure Activity. Cancellation rights are over and above consumer law.
- 5.10 Where the Customer has
- 5.10.1 Booked a Theory Test and fails to pass or take their Theory Test then any existing training days, Mod 1 and Mod 2 test days shall still be attended by the Customer for training. Any new test days will require booking by the Customer. The Company shall not be liable for any lost Mod 1 and Mod 2 test fees.
- 5.10.2 Failed to take or pass their Mod 1 test before their Mod 2 test date, then any existing training days and Mod 2 test days shall still be attended by the Customer for training. The Company shall not be responsible for the loss of any subsequent Mod 2 Test fees.
- 5.11 The Company shall indicate alternative availability dates to the Customer for any of the Theory, Mod 1 and Mod 2 tests not successfully passed in accordance with DVSA test availability.
- 5.12 Any cancellation of a Theory, Mod 1 or Mod 2 motorcycle test by the DVSA will require a new test and any training time delivered by the Company to be rebooked and paid for by the Customer. The Customer may be able to reclaim the costs of the test, training and out of pocket expenses in accordance with DVSA policy.
- 5.13 Any gift voucher issued by the Company is valid for 3 months from the date of issue. Any unused gift voucher will expire without notice with the loss of its monetary value to the Customer.
- CBT Course
- 6.1 For any CBT course
- 6.1.1 A Customer’s CBT course will end at the time of any CBT element that they have not successfully completed.
- 6.1.2 A Customer who does not successfully complete all 5 elements of a CBT course within their first CBT Course booking may rebook for further training in any required element(s) upon payment of a Fee. The Fee is reduced from the full CBT fee in proportion to the amount of further training required.
- 6.1 For any CBT course
- Damages
- 7.1 The Customer will pay for any damage caused by them to any vehicle or equipment belonging to the Company. Parts will be charged at full retail price plus a labour rate of £50 per hour (Max £350), to carry out any works required. Payment to be made immediately on request by the Company. Any further training may be cancelled without refund if payment is not made on request. The Customer will be liable for any test fees lost as a result of damage.
- 7.2 If, due to customer damage, a motorcycle is no longer available for training, outstanding training days and tests will be cancelled with Fees forfeit.
- Force Majeure
- 8.1 If due to war, strikes, industrial action in short of a strike, lock outs, accidents, fire, blockage, import/export embargo, ice obstruction, natural catastrophes or other obstacles over which the Company has no control or the Company fails to supply the Course, the Company shall not be held responsible for any loss or damage which may be incurred by the Customer as a result of such failure.
- 8.2 The Customer should understand that motorcycling can be dangerous and to undertake training is at your own risk. The Company, their employees or agents shall not be held liable for any loss or damage to the Customers property or injury or death unless directly due to the negligence or failure of the Company.
